The following table summarises the rejected Agri-Environment Climate Scheme (AECS) applications, specifically Improving Public Access (IPA), that have been appealed. It records the number of applications that were (a) upheld following appeal and (b) are awaiting a decision, in each year since 2015.

Please note that the 2020 round was not open to new applications, rather a one year’s extension was offered to all Management options that were due to end in 2020. Not all businesses accepted the offer. IPA is not a Management Option, it is capital only, and as such was not included in the round.

The 2021 round that closed at the beginning of July 2021 was also extended. These applications are still being assessed.

We are working with the other administrations on the introduction of an extended producer responsibility system for packaging that will require producers to cover the full net cost of their packaging when it becomes waste. This will encourage producers to reduce unnecessary packaging and improve the sustainability of their packaging.

Public bodies already have a legal duty to take account of how they can improve social, economic and environmental wellbeing in their procurement activities. We have published guidance on waste and efficient resource consumption on our Sustainable Procurement Tools platform to support public bodies in reducing waste in their supply chains. This guidance highlights packaging as an example of where significant waste may arise, and provides examples of where reducing/ eliminating packaging can be included in the Contract Notice and Specification. In January 2021 we published SPPN 1/2021: Taking account of climate and circular economy considerations in public procurement. This policy note signposts the guidance published on the Tools and clarifies expectations with respect to circular economy considerations in procurement, outlining that procurement professionals should consider whether they can buy refurbished, repaired or pre-used rather than new.

The Scottish Government frequently includes requirements for recycling and recycled materials in our frameworks and contracts. Our IT Consumables Framework - a national framework that can be used by all public bodies across Scotland - requires the supplier to recycle all inbound packaging and encourage their partners to reduce packaging. Our Facilities Management Services Framework requires the supplier to sustainably source materials including packaging, and promote waste reduction and the circular economy through including recycled content in materials, including packaging.

I fully understand that those with MS and other long term neurological conditions may need support to cope with potential impacts upon their mental wellbeing.

Over the past 13 months we have invested over £300,000 to projects which specifically aim to improve the health and wellbeing of people with MS in Scotland.

Improving timely access to local care and support for mental health is an existing priority. As of 1 January 2021, through action 15 of the Mental Health Strategy 2017-27 and the Primary Care Improvement Fund, 193 additional Mental Health Worker posts have been created in GP settings.

We have also made a longer term commitment that by 2026, every GP Practice will have access to a mental health and wellbeing service, funding 1,000 additional dedicated staff who can help grow community mental health resilience and offer social prescribing opportunities on a wide range of services such as arts and cultural activities, green space, physical activity and leisure. Later this year, and on the basis of local plans submitted by Integration Authorities, we will start providing funding to begin national implementation of a new model for Mental Health in Primary Care.

The Inquiries into Fatal Accident and Sudden Deaths Act 2016 places a duty on a person to whom a sheriff’s recommendation is addressed to provide a response to the Scottish Courts and Tribunals Service within the period of 8 weeks after the respondent receives a copy of the determination.

The respondent must give the SCTS a response in writing either :

• setting out details of what the respondent has done or proposes to do in response to the recommendation, or
• if the respondent has not done, and does not intend to do, anything in response to the recommendation, the reasons for that.

The 2016 Act also place a duty on SCTS to publish responses to the recommendations set out in the determination.

Where a response is given the SCTS must

• publish the response in full,
• publish the response in part, together with a notice explaining that part of the response has been withheld from publication, or
• publish a notice explaining that the whole of the response is being withheld from publication.

The SCTS may withhold the whole of a response from publication only if representations are made to that effect. If no response is given by the end of the 8 week period the SCTS must publish notice of that fact.

Implementation of FAI recommendations are monitored by the annual statistics. The Scottish Parliament receives a copy of the report annually. All responses to recommendations are published and are in the public domain which includes respondents saying what has been done and if the answer is nothing, then explaining why.

The Scottish Government expects all public bodies to respond appropriately to the recommendations of a Fatal Accident Inquiry.

Court operational matters, including the system for jury service, fall within the remit of the independent Scottish Courts and Tribunals Service (SCTS).

In November 2019, SCTS announced new services for jurors with a visual impairment or who are hard of hearing as recommended in Lord Matthews 2018 “Enabling Jury Service” report.

These adjustments and measures widened the accessibility for as many people as possible to serve on include:

• easy-to use hearing loop units and magnifiers for use in the courtroom and jury deliberations;
• dedicated and trained Jury Liaison Officers, who can be contacted by persons with a visual impairment or who are hard of hearing in advance of attending court as a juror. This will allow the needs of the individual to be explored and any suitable adjustments to be considered and implemented, where possible; and
• an information sheet in various formats – including a video with British Sign Language and subtitles aimed at encouraging early contact between the person cited for jury service and the Jury Liaison Officer for that court.

In developing these services, SCTS worked closely with deafscotland and the Royal National Institute of Blind People, who contributed to the training of Jury Liaison Officers.

There is, of course, more to do to support greater accessibility for jurors and SCTS have provided assurances that they will consider further initiatives as opportunities arise during the business planning process.

The preservation of a crime scene is for the purposes of protecting the integrity of forensic evidence. A decision to allow a priest to enter an area designated as a crime scene is therefore an operational matter for Police Scotland.

We are working to implement our ‘ Framework on Recovery and Rehabilitation from COVID-19’ , which puts in place clear principles, priorities and objectives to support planning to meet increasing demand and provide high quality person-centred rehabilitation in different settings. A National Advisory Committee on Rehabilitation has been convened to oversee the implementation of the ‘Recovery and Rehabilitation Framework’. The board meets regularly, and minutes of these meetings can be viewed on our webpage here .

The rehabilitation programme has undertaken a significant scoping exercise through a self-assessment process to understand the current status of rehabilitation services in Scotland, from the perspective of the staff working in them.

The self-assessment tool has been circulated to all NHS Boards, Health & Social Care Partnerships, COSLA, third sector organisations, and Leisure Trusts as part of Local Authorities. The outputs from the self-assessment tool along with demand and capacity data will help us shape priorities, understand challenges and opportunities and inform funding decisions.

We will develop and implement a rehabilitation plan that will ensure everyone who requires rehabilitation will be able to access it, including those with a neurological condition.

As previously set out, the Scottish Government and Zero Waste Scotland introduced a Carbon Metric for waste from 2011, making Scotland the first country to measure the carbon impact of its waste in this way, and delivering on our commitment set out in Scotland’s Zero Waste Plan.

The first metric of Scotland’s waste carbon footprint was published in 2013 by Zero Waste Scotland. The metric measures the whole-life carbon impacts of Scotland’s waste, and is a vital tool in our work to address the climate emergency.

The metric was developed by Zero Waste Scotland on behalf of Scottish Government, with input from SEPA and a steering committee formed from experts belonging to the Chartered Institution of Wastes Management.

The Scottish Government is commissioning an evaluation of the pilot approach to early learning and childcare (ELC) access for children who defer Primary 1. The evaluation research will include data collection with a sample of parents in pilot local authorities to explore their perceptions and experiences of the entitlement. We anticipate that full evaluation findings covering year 1 and 2 pilots will be published in spring 2023. Interim findings will be shared with the Deferral Working Group and published on the Scottish Government website.
