To ask the Scottish Executive what steps have been taken by NHS Argyll and Clyde to involve the public as fully as possible in the consultation on its clinical strategy review.
Answer
While the details are a matterfor NHS Argyll and Clyde, at the conclusion of the process I will want to be assured that all views have been takeninto account in drafting the proposals and that the consultation has been fullyconsistent with the Executive guidance on public engagement.

To ask the Scottish Executive whether it can provide any information in respect of the si'e of land banks available for development held by private housing developers and, if not, where such information can be obtained.
Answer
The Scottish Executive does not collate information centrally on the land and property holdings of private companies.
Information about the ownership of land can be obtained, upon payment of a fee, from the Registers of Scotland. However, the Registers of Scotland do not record whether land is available or has authorisation for development.

To ask the Scottish Executive what percentage of the cost of an HND course fee is paid for by the Scottish Higher Education Funding Council and whether this contribution is considered as student support for the purpose of calculating future assistance.
Answer
The Scottish Higher Education Funding Council (SHEFC) allocates funding for teaching to higher education institutions in the form of a block grant. Allocations are based on the number of funded places in each of 13 funding subject groups and the unit resource cost attributed to each group. Institutions are not, however, required to allocate the funding internally using the same formula. The proportion of the cost of providing a particular HND course which is attributable to SHEFC funding will, therefore, depend partly upon decisions made by individual institutions.
From academic year 2004-05 the fact that a student has previously taken up a place on a SHEFC funded course will be disregarded by SAAS when assessing a student’s eligibility for tuition fee support.

To ask the Scottish Executive under what circumstances course fees would be paid for HND students who repeat any part of their course.
Answer
The Student Awards Agency for Scotland can pay tuition fees on behalf of higher education students for repeated or extended study where there are medical or strong compassionate reasons such as the death or serious illness of a close relative.

To ask the Scottish Executive whether it will review pages 15 and 16 of the Code of Practice for the Adults with Incapacity (Scotland) Act 2000 which determine the application of legal aid for guardianship applications and intervention orders.
Answer
As part of an overall monitoring exercise of the implementation of the Adults with Incapacity Act 2000, the Executive is in discussion with the Scottish Legal Aid Board, the Law Society of Scotland and other interested parties with a view to identifying difficulties in accessing legal aid and measures which will improve the current situation. Any amendment to the code of practice will be considered on conclusion of these discussions.

To ask the Scottish Executive what its strategy is to deal with anti-social behaviour linked to alcohol.
Answer
Irresponsible use of alcohol fuels anti-social behaviour. We are taking comprehensive action on anti-social use of alcohol through our plans for liquor licensing reform, which were published on 17 May; through the alcohol action plan and through the implementation of the Anti-social Behaviour Bill and the wider strategy in which it sits.

To ask the Scottish Executive whether there have been any discussions between the Scottish Ambulance Service and NHS Argyll and Clyde about the clinical strategy review and, if so, when such discussions took place, who was in attendance and what was discussed.
Answer
The Scottish Ambulance Service is a member of the NHS Argyll and Clyde Modernisation Board which has provided governance for the Clinical Strategy Review. Senior managers from the ambulance service’s South West Division have attended six meetings of the Modernisation Board, the first on 27 August 2003 and the most recent on 27 May 2004. NHS Argyll and Clyde was represented by a number of officials including the Chief Executive. The full minutes of the meetings are available on NHS Argyll and Clyde’s website.
The clinical strategy has also been discussed in other fora at which the ambulance service and NHS Argyll and Clyde have been represented.
The discussions have informed a better understanding of the possible implications for both services of the options emerging from the review.
