Delegated Powers and Law Reform Committee

Instruments subject to Negative Procedure

Meeting date: 13 May 2025

Bill Kidd

Under agenda item 3, we are considering five instruments. Points have been raised on three of the instruments, which form a package.

Delegated Powers and Law Reform Committee

Instruments subject to Negative Procedure

Meeting date: 13 May 2025

Bill Kidd

The instruments amend different sets of regulations from 2023 and make some new provisions. The 2023 regulations made changes that were necessary following a successful court challenge in 2018, which was related to public sector pension schemes.

The committee considered the earlier instruments at its meeting of 19 September 2023. In its report from that meeting, the committee drew all of them to the attention of the Parliament, having identified drafting points in each instrument.

In relation to the present instruments, the committee has raised further issues with the Scottish Government. The full correspondence, which was published alongside the papers for this meeting, sets out its questions in full. The committee’s full findings will be set out in its report, which will be published in due course and will detail its consideration of subordinate legislation at this meeting.

In relation to Scottish statutory instrument 2025/113, does the committee wish to draw the instrument to the attention of the Parliament on reporting ground (i)—defective drafting—in respect of the issues that it raised in relation to its questions 1 and 3 on this instrument; and on the general reporting ground in respect of the issues that it raised in relation to questions 2(2), 4, 5(1), 7, 8(1) and 9 on this instrument?

Members indicated agreement.

In relation to SSI 2025/114, does the committee wish to draw the instrument to the attention of the Parliament on the general reporting ground, in that the Scottish Government’s commitment of 12 September 2023 to correct, by correction slip, an error in the preamble of the Police Pensions (Remediable Service) (Scotland) Regulations 2023 (“the Principal Regulations”) has not been fulfilled; that, in line with standard drafting practice, regulation 3 of the instrument should specify that the substitution is to be made in both instances where “an immediate choice election” appears; that, in line with standard drafting practice, regulation 5 of the instrument should specify that the substitution is to be made in both instances where “deferred choice election decision” appears; and that the erroneous reference to “regulation 22(3) and (4)” in regulation 7 of this instrument should be to “regulation 23(3) and (4)”?

Members indicated agreement.

Education, Children and Young People Committee

Tertiary Education and Training (Funding and Governance) (Scotland) Bill: Stage 1

Meeting date: 7 May 2025

Bill Kidd

Thank you both for taking on board the background to the different questions that you have been asked, including many on the SFC.

I hope that my question is not as difficult as it sounds. What is your assessment of the bill’s proposals to change the membership of the SFC, including the terms of reappointments and in relation to the skills and experience of members, and to introduce co-opting powers for the SFC?

That is very positive. Thank you very much indeed.

That is helpful. Thank you both.

On an awareness-raising campaign, from what you have said and what we have uncovered, as it stands, the bill will affect an awful lot of people who are unaware. Perhaps some of them should be aware, but a lot of people who do not have any legal background whatsoever will not be aware of the outcomes of what is being talked about. This might sound like a strange thing to say, but should the Scottish Government carry out an awareness-raising campaign to ensure that the many affected people will fully understand the impact of the bill? Should such a campaign be conducted and how do you think that could best be done?

Bill Kidd

Given what you have said, do you think that the new rules on giving notice might be difficult to follow due to potential complexity? Do you think that complexity is an issue in the new proposals overall?

Thank you both very much. It is helpful to have witness panels 1 and 2 going in the same direction.

You were both in the room when I asked the two academic witnesses on the earlier panel for their views on the arguments and responses to the call for views that suggested that the Scottish Government should carry out an awareness-raising campaign. The two doctors were of the opinion that this is an educational situation in which people need to learn more about their rights and be aware of them, so that they do not find themselves in difficult circumstances so often. People would then be prepared for anything that took place that was not necessarily what they had been looking for.

On that basis, to make sure that landlords and tenants are aware of all the new and different aspects of the policy that will be coming towards them, should there be an awareness-raising campaign on the suggestions and proposals that are in the legislation?
