Scottish Government response to SCoSS report on Adult Disability Payment

Letter from Minister of Social Security and Local Government, 1 October 2021

Dear Neil/Convener,

I am pleased to inform you that today the Scottish Commission on Social Security (SCoSS) published their report and recommendations on the Adult Disability Payment draft regulations (The Disability Assistance for Working Age People (Scotland) Regulations). As per section 97 of the Social Security (Scotland) Act, the report was also submitted to Parliament.

As you know, the Scottish Government referred draft regulations to SCoSS on 25 June. The regulations have since undergone further drafting changes, in part as a result of helpful discussions between officials and the Commission, for which I am most grateful. I therefore attach to this letter the updated draft regulations upon which SCoSS have based their report. These regulations have also been published today on the Scottish Government website. 

I extend my sincere gratitude to SCoSS for their scrutiny of the draft regulations and their constructive engagement with the Scottish Government. This is especially so given the significant challenge presented by the scale and complexity of disability assistance legislation. We will consider the recommendations in the report carefully and we will respond to them in due course. 

I look forward to further engagement with the Committee on these draft regulations.
