Thank you for your letter of 18 November regarding the Wine (Amendment) Regulations 2021.
I attach a revised notification that provides the additional information that you have requested, primarily in the section headed “A brief overview of the SI (including reserved provision)”. I hope that this provides you with answers to the questions you raised including clearer detail on what exactly the SI will do, how it will change the existing legislation, transitional arrangements and the position with regard to reserved and devolved matters covered by the SI.
The regulations to implement the wine-related provisions from the Trade and Cooperation Agreement have been drafted on a GB basis which is consistent with the approach taken with similar SIs where Scotland’s interests are minimal.
The SI is expected to be laid on 23 November and is due to come into effect on 1 January 2022. I apologise for the fact that the full 28 days for parliamentary scrutiny has not been provided. The reason was that there was some confusion at official level about whether this SI met the criteria for a Type 2 notification.
We do not have confirmed dates but we understand that the debates for the SI are expected to be held between 7 December and 14 December and the SI should be made by 16 December.
