1. Decision on taking business in private:

The Committee agreed to take items 5, 6, 7 and 8 in private.


2. Instruments subject to affirmative procedure:

The Committee agreed that no points arose on the following— 

Agriculture and Horticulture Development Board (Amendment) Order 2023 (SI 2023/Draft)
Land and Buildings Transaction Tax (Green Freeports Relief) (Scotland) Order 2023 (SSI 2023/Draft)
Deer (Firearms etc.) (Scotland) Amendment Order 2023 (SSI 2023/Draft)




3. Instruments subject to negative procedure:

The Committee agreed to bring to the attention of the Parliament the following—

Legal Aid and Advice and Assistance (Miscellaneous Amendment) (Scotland) (No. 3) Regulations 2023 (SSI 2023/178)

The Committee agreed that no points arose on the following— 

National Health Service (Free Prescriptions and Charges for Drugs and Appliances) (Scotland) Amendment Regulations 2023 (SSI 2023/181)
Deer (Close Seasons) (Scotland) Amendment Order 2023 (SSI 2023/184)


4. Instruments not subject to any parliamentary procedure:

The Committee agreed that no points arose on the following— 

Management of Offenders (Scotland) Act 2019 (Commencement No. 7) Regulations 2023 (SSI 2023/182 (C.18))
Good Food Nation (Scotland) Act 2022 (Commencement No. 1) Regulations 2023 (SSI 2023/183 (C.19))




5. Economic Crime and Corporate Transparency Bill (UK Parliament legislation) (in private):

The Committee considered the supplementary legislative consent memorandum on the Bill and agreed to write to the Scottish Government.


6. Data Protection and Digital Information (No.2) Bill (UK Parliament legislation) (in private):

The Committee considered the responses received from the Scottish Government and the UK Government on the powers to make subordinate legislation within devolved competence in the Bill. The Committee agreed to report to the lead Committee, the Economy and Fair Work Committee.


7. Quarterly report (in private):

The Committee considered a draft report for the parliamentary quarter from 1 March to 12 May 2023 and agreed to publish the finalised report.


8. Work programme (in private):

The Committee considered its work programme, including agreeing to invite the Minister for Parliamentary Business to give evidence at a future meeting, seeking a date to visit the Scottish Law Commission, and consideration of approaches to an expedited affirmative procedure for instruments which could have been laid under the “made affirmative” procedure.
