Books of condolence

This privacy statement explains how we collect and use personal information as a data controller for the purposes of recording tributes in books of condolence following the death of former MSP and First Minister Rt Hon Alex Salmond.

Some of the language used in privacy notices can be specialised.  The Information Commissioner's website provides a useful introduction to key terms and concepts.


The purpose of the processing

Personal data will be processed for the purposes of compiling a book of condolence at the Scottish Parliament and, for people unable to attend the parliament in person, an online book of condolence. 

Categories of information processed

Normal category data – data including your name and your message of condolence.

Depending on the information you choose to provide this may result in the processing of special category data such as information about race or ethnic origin and political views and opinions.

Special category data – data as defined by the UK General Data Protection Regulation. Special category data applies to personal data revealing:

  • an individual’s race or ethnic origin
  • political or religious views
  • sex life or sexual orientation
  • trade union membership
  • physical or mental health
  • genetic or biometric data.

Source of the information 

The information is provided by individuals contributing to the book of condolence and the online book of condolence.

Legal basis for processing

Data protection law states that we must have a legal basis for handling your personal data.

For the processing of personal data in relation to contributions to the book of condolence, the legal basis for the processing of personal data is that it is carried out in the legitimate interest of the SPCB. The legitimate interest is the engagement with the public and facilitating members of the public to contribute to the book of condolence to mark the life of Alex Salmond (Article 6(1)(f) UK GDPR).

For special category personal data, the special condition for processing will be explicit consent (Article 9(2)(a) UK GDPR) as long as you tick the box to indicate that you are content for your name to be shared with Alex Salmond’s family. If you do not tick this box, your contribution will be shared anonymously.

Data sharing

Following completion of the book of condolence and the online book of condolence the book and messages received online will be shared with the family of Alex Salmond.

Retention of data 

Messages of condolence issued via the online book will be reviewed when the book closes, to ensure they are in line with the purposes set out above. Any contributions that include inappropriate wording will be removed. Messages that are in scope will be sent to Alex Salmond’s family, following which all messages will be removed from our systems.

Your rights

Data protection law sets out the rights which individuals have in relation to personal data held about them by data controllers. Applicable rights are listed below, although whether you will be able to exercise data subject rights in a particular case may depend on the purpose for which the data controller is processing the data and the legal basis upon which the processing takes place.

Access to your information

You have the right to request a copy of the personal information about you that we hold (please note that the SPCB will no longer hold information in the book of condolences once this has been shared with the family). Correcting your information

We want to make sure that your personal information is accurate, complete, and up-to-date and you may ask us to correct any personal information about you that you believe does not meet these standards. 

Objecting to how we may use your information

Where we use your personal information to perform tasks carried out in the public interest then, if you ask us to, we will stop using that personal information unless there are overriding legitimate grounds to continue.

Restricting how we may use your information

In some cases, you may ask us to restrict how we use your personal information. This right might apply, for example, where we are checking the accuracy of personal information about you that we hold or assessing the validity of any objection you have made to our use of your information. Where this right is validly exercised, we may only use the relevant personal information with your consent, for legal claims or where there are other public interest grounds to do so.

Child Protection 

In line with the principles underlying the National Guidance for Child Protection in Scotland (2014), published by the Scottish Government, our staff may report a concern to the relevant authorities if they come across an issue in the course of their work which causes them to think that a child may be at risk of abuse or harm.
